Importance of an independent third party for disciplinary hearings

There are a number of reasons why it is important to have an independent third party conduct a disciplinary investigation, hearing or appeal.




These include:

  • Time constraints and managers lacking the courage and confidence to engage in difficult conversations;

  • Outsourcing the service ensures that the organisation can focus their time on core activities and be reassured that all disciplinary matters are handled expertly and efficiently;

  • Having a third party conduct the hearings ensures impartiality and correct adherence to due process, which can be highly beneficial for the employer if methodology and approach come under scrutiny at the CCMA;

  • External consultants are able to judge situations without prejudice or bias, and are able to judge in a fair and impartial manner;

  • Lastly, the external consultant often has previous experience in related employment issues and can assist in ensuring that the correct outcome is achieved.
